CMS rejects one-third of Sunshine Act data

Ayla Ellison -

CMS will withhold one-third of the records it received from pharmaceutical and medical device makers under the Physician Payments Sunshine Act due to errors identified in the records, according to a report by ProPublica.

The rejection of the records comes two weeks after CMS announced it would delay publicly launching its Open Payments website — an online portal listing payments from drug and device makers to physicians. CMS decided to suspend the Open Payments portal after a physician saw payments to another physician with the same name in his records.

The records that are being returned to manufacturers and organizations with errors will not be posted until June 2015. It is still unclear how many records are being withheld, but the number could be into the tens of millions, according to the report.
