Banner Health Settles Discrimination Charges With EEOC

Phoenix-based Banner Health has reached a $255,000 settlement with the U.S. Equal Employment Opportunity Commission, resolving allegations that it denied an employee's requests for accommodation and fired him because of his disability.

The system hired Lee Fladmo as a kitchen worker and dietary aide in 1984. Mr. Fladmo has an intellectual disability but was able to perform his duties with reasonable accommodation. He allegedly made numerous requests for accommodation that were ignored.

In 2002, following a charge of discrimination filed with the EEOC, Banner reached a mediated settlement. It vowed to not take actions regarding Mr. Fladmo's employment without addressing them with his brother, who had power of attorney. Roughly three years later, Banner refused Mr. Fladmo's request for accommodation — breaching the mediation agreement — and ultimately fired him.

In addition to the $255,000, Banner must also provide training on disability discrimination for managerial and supervisory employees at its Gateway Medical Center in Gilbert, Ariz.
