70-year-old woman sues New York physician for allegedly taking Spanish language exam during operation

Mary Edwards, 70, filed a lawsuit against a Purchase, N.Y.-based Westmed Medical Group physician for allegedly using his cellphone to complete a Spanish language proficiency exam while operating on her, according to lohud.

Eric Fishman, MD, had a conversation on his cellphone about diabetes and blurred vision while operating on Ms. Edwards to fix a varicose vein, according to the lawsuit.

Ms. Edwards claimed after the operation, Dr. Fishman explained the conversation was in reference to a proficiency exam he needed to complete to provide better care for his Spanish-speaking patients. He said the only time he had to complete the exam was during the operation, the lawsuit states.

Ms. Edwards said Dr. Fishman also spoke of another patient's medical records with a hospital employee while conducting surgery on her in April.

The lawsuit also contends Dr. Fishman and at least two other Westmed officials acknowledged his behavior was inappropriate during a meeting with Ms. Edwards.

Ms. Edwards claimed she suffered emotional distress and is seeking unspecified monetary damages, the report states.

A spokesperson for Westmed reportedly told lohud the organization does not comment on patient care or pending litigation.
