FTC Requests Supreme Court Review of Georgia Hospital Sale

The Federal Trade Commission has continued its challenge of the Palmyra Medical Center in Albany, Ga., sale to Phoebe Putney Health System also in Albany, according to Georgia Public Broadcasting report.

The FTC has requested an extension on its deadline to submit its request to the U.S. Supreme Court.

Phoebe Putney purchased Palmyra Medical in December 2011. The Federal Trade Commission opposed the sale citing antitrust issues. The 11th Circuit Court of Appeals ruled in favor of the acquisition claiming the transaction was protected by state-action immunity and is not subject to federal scrutiny.
