AHA, FAH to Congress: Keep ban on self-referral to physician-owned hospitals

The American Hospital Association and the Federation of American Hospitals issued a joint statement to Congress Jan. 11 urging lawmakers to oppose legislation that would allow self-referrals to physician-owned hospitals.

Congress enacted legislation in 2010 mandating no new physician-owned hospitals can bill Medicare or Medicaid for services. The law also barred self-referrals to physician-owned hospitals.

In their statement to Congress, the organizations cited data indicating physician-owned hospitals are more likely to cherry-pick patients, treat fewer medically complex patients and provide fewer emergency services. The data also indicated physician-owned hospitals are penalized at a rate 10 times higher than non-physician-owned hospitals for unnecessary readmissions.

"The law as it stands protects patients, businesses and taxpayers. It also helps ensure that community hospitals can continue to fulfill their mission to provide quality care to all the patients in their communities. We urge you to oppose any and all attempts to weaken it," the organizations said.
