Mountainview Medical Center Sues NextGen Over EHR Installation

Mountainview Medical Center in White Sulpher Springs, Mont., has filed a lawsuit against electronic health record vendor NextGen Healthcare for allegedly failing to install a meaningful use-compliant system on time.

The suit claims the original 2012 contract stated a system that would allow the hospital to attest to meaningful use stage 1 would be installed by June 1, 2013, according to an article in the Helena Independent Record. After this deadline was missed, the hospital extended the deadline to Oct. 1, 2013. However, according to the suit, in September the hospital learned NextGen's system would not meet meaningful use criteria.

"At no time on or before Oct. 1, 2013, did NextGen appear, attempt to install and make operational a certified EHR system at MVMC," the lawsuit states. According to the suit, MVMC had spent approximately $441,000 on the installation.
