The suit, which was brought by a handful of the benefit’s recipients, argued the proposed cuts set higher standards for recipients of home care than those living in adult care homes. The state had planned to tighten eligibility restrictions for home care — requiring recipients to demonstrate a need of assistance with three, rather than two, “activities of daily living” — as part of its 2010 budget, according to the report. The changes were estimated to save the state $50 million.
The state’s Department of Health and Human Services is expected to appeal to ruling.
