Judge dismisses parts of data breach lawsuit against UnityPoint

A federal judge will allow patients to go forward with parts of their lawsuit against West Des Moines, Iowa-based UnityPoint Health after a data breach, according to local ABC affiliate WKOW.

Four patients filed a lawsuit against UnityPoint shortly after learning about two security breaches in which patient information was affected in 2018. UnityPoint promptly filed a motion to dismiss the lawsuit.

In late July, a U.S. District Court judge ruled that the patients can move forward on claims that regard breach of contract, breach of the covenant of good faith and fair dealing and unjust enrichment, reports WKOW. Patients also can move forward with claims of negligence, negligence per se and claims for violation of the confidentially of medical records statue.

The judge dismissed patients' claims of invasion of privacy, misrepresentation, violation of data breach notification statutes and violation of consumer fraud statutes, WKOW reports.
