HHS may consider changes to HIPAA

HHS may consider proposing modifications to HIPAA rules to allow for more coordinated care in a value-based healthcare context.

The agency may seek comments on a proposal which would remove roadblocks that limit or discourage care coordination and case management among hospitals, physicians, payers and patients. The proposal aims to decrease what it deems "unnecessary compliance burdens" while continuing to protect patients' privacy and health information.

The proposal also aims to strengthen patients' ability to access PHI.

In a separate potential proposal, the agency aims to modify the HIPAA Enforcement Rule and establish methodology for distributing civil money penalties and monetary settlements between individuals harmed by breaches.
