Psychiatrist Files $8M Suit Against Tanner Medical Center in Georgia

Psychiatrist Randy Warner, MD, has filed an amended lawsuit against Tanner Medical Center in Carrollton, Ga., alleging the hospital engaged in illegal activities to keep Dr. Warner "as a captive physician" to maximize profits.

Dr. Warner, who had staff privileges at TMC since late 2004, claims TMC monitored his personal and financial information, tampered with his professional relationships and conducted wire and mail fraud by billing third-party payors for services Dr. Warner provided. The lawsuit alleges six counts of misconduct, including racketeering, infliction of emotional distress, invasion of privacy and fraudulent billing.

Dr. Warner alleges the hospital tried to keep him as a "captive physician" through its "ongoing strategy to control, if possible, the private medical practices it is unable to acquire," According to the news release. There are also allegations that TMC tried to prevent Dr. Warner from admitting patients to other hospitals through retaliatory action, according to the suit. TMC suspended Dr. Warner's privileges this month.

The lawsuit seeks monetary damages in excess of $8 million.
