3 patient recruiters sentenced in $20M False Claims, Anti-Kickback scheme

Three patient recruiters have been sentenced for their involvement in healthcare fraud and kickback scheme while working for Miami-based Trust Care Health Services, a home healthcare company, according to the FBI.

In July, Estrella Perez and Solchys Perez pleaded guilty to conspiracy to commit healthcare fraud, and Abigail Aguila pleaded guilty to conspiracy to defraud the U.S. and receive healthcare kickbacks.FBI logo

As part of the scheme, the three recruited patients for Trust Care in exchange for kickbacks, which were paid in cash or by check to the defendants or their shell companies. Trust Care would then bill Medicare for home healthcare and other services that were not medically necessary or were never provided, according to the report.

From March 2007 through January 2010, Trust Care submitted approximately $20 million in false claims for home health services.

Estrella Perez and Solchys Perez also paid kickbacks and bribes to co-conspirators in physicians' offices and clinics in exchange for home health and therapy prescriptions, plans of care and medical certifications for their recruited patients, according to the report.

Estrella Perez, was sentenced to serve 37 months in prison, followed by three years of supervised release, and ordered to pay $1.17 million in restitution. Solchys Perez was sentenced to serve 30 months in prison followed by three years of superviced release, and ordered to pay $746,600 in restitution. Abigail Aguila was sentenced to serve 30 months in prison, followed by three years of supervised release, and ordered to pay $491,438 in restitution.
