19 recent lawsuits involving hospitals

The following hospital lawsuits were reported since June 20.

1. Jury orders Tri-City Medical Center to pay nearly $20M for breached contract 
A jury ordered Oceanside, Calif.-based Tri-City Medical Center to pay a private management and funding company nearly $20 million, plus attorney fees, in a dispute regarding the hospital's three-story medical office building.

2. Bacterial infections at York Hospital prompt 2 lawsuits 
Two lawsuits were filed at the York (Pa.) County Court of Common Pleas against WellSpan Health and medical device manufacturer LiveNova. The complaints come eight months after WellSpan York Hospital notified 1,300 open-heart surgery patients they may have been exposed to harmful bacteria between 2011 and 2015.

3. FTC dismisses complaint challenging West Virginia hospital merger
The Federal Trade Commission is dismissing its administrative complaint challenging the proposed merger between Cabell Huntington (W.Va.) Hospital and Huntington-based St. Mary's Medical Center.

4. Patient shot by off-duty officer sues Houston hospital 
A patient shot last August by an off-duty police officer at St. Joseph Medical Center in Houston is suing the hospital and its parent company Franklin, Tenn.- based IASIS Healthcare as well as the City of Houston and four of its police officers.

5. Fla. hospital sued after maggots found in patient's mouth
Orange Park (Fla.) Medical Center is facing a lawsuit from a former patient's family after maggots were found in the patient's mouth during a post-surgery stay.

6. Pacifica Hospital to pay $1M settlement for patient dumping
Pacifica Hospital of the Valley agreed to pay $1 million to resolve allegations that the Sun Valley, Calif.-based hospital failed to follow homeless patient discharge protocols when it sent a patient by taxi to a nursing home

7. UW Medicine hospital broke charity care law, class-action suit claims 
A class-action lawsuit brought on behalf of two low-income men alleges Northwest Hospital & Medical Center in Seattle fails to properly screen patients for charity care in violation of the Washington state Charity Care Act.

8. Lawsuit claims misdiagnosis, unnecessary removal of organ and cover-up at KU Hospital
A whistle-blower lawsuit filed July 1 by a physician from the University of Kansas Hospital in Kansas City alleges the chair of the hospital's pathology department misdiagnosed a patient with cancer and covered up the mistake for months after the patient had an essential organ surgically removed.

9. Jury awards former Covenant Medical Center employee $500k for wrongful termination 
A federal jury awarded more than $500,000 to a former Covenant Medical Center employee, finding that her termination from the Saginaw, Mich.-based hospital was retaliation for taking medical leave.

10. Nurses claim discrimination in lawsuits against NJ hospital 
Four lawsuits filed on behalf of former nurses of Capital Health Regional Medical Center in Trenton, N.J., claim the nurses faced months of racial and disability discrimination before they were unjustly fired.  

11. UC Health nurse sues health system for covering up scope-related outbreak 
A University of Cincinnati Health nurse filed a whistle-blower lawsuit against the system, claiming UC Health failed to prevent the spread of multidrug-resistant bacteria and covered up its role in the outbreak.

12. UChicago Medical Center to pay $53M in birth injury lawsuit
In the biggest birth injury verdict ever in Cook County, a jury awarded a 12-year-old boy and his mother $53 million in a medical malpractice lawsuit filed against University of Chicago Medical Center.

13. Nurse sues Texas hospital for allegedly working through lunch without pay 
A nurse sued Houston-based Memorial Hermann Health System on grounds the system required her to work through her lunch break without pay.

14. Physician suing Charleston hospital for harassment that allegedly shuttered her practice 
An ob-GYN is suing Charleston (W.Va.) Area Medical Center and West Virginia University Medical Corporation-Charleston Division for claims that harassment and discrimination forced her to close her local practice.

15. Judge lets Prouty Garden lawsuit against Boston Children's Hospital move forward 
Opponents of Boston Children's Hospital's $1 billion plan to expand its campus by building over the Prouty Garden are allowed to carry on its lawsuit against the hospital, a Suffolk Superior Court Judge decided.

16. Former Aspen Valley Hospital District worker sues hospital for disclosing HIV status
A former employee of the Aspen (Colo.) Valley Hospital District is suing the hospital, alleging the organization breached his right to privacy when it disclosed he was HIV positive.

17. Mercy files $4.1M suit against Aetna for allegedly withholding reimbursement 
Chesterfield, Mo.-based Mercy filed suit against Aetna, claiming the health insurance company failed to pay the full amount owed for care provided to certain newborn babies.

18. Hospitals sue BCBS of Georgia for sending ED reimbursements to patients 
Two hospitals in Georgia and California are individually suing Blue Cross and Blue Shield of Georgia for sending reimbursement money for emergency department care directly to patients.

19. Family sues hospital after newborn overdoses on insulin
While being treated for complications at birth in the Neonatal Intensive Care Unit at Brookwood Medical Center in Birmingham, Ala., a newborn was given an overdose of insulin. The parents of the child are now suing the hospital.
