What's the latest on the ACA's birth control mandate?: 3 things to know

Some religious nonprofits remain hopeful for a reversal of the ACA's birth control mandate, reports The Washington Post.

Here are three things to know.

1. The ACA's birth control mandate requires insurers on the exchanges to cover contraception and counseling for women. However, the mandate exempts health plans sponsored by certain religious employers, including churches. Additionally, some nonprofit religious organizations — such as nonprofit religious hospitals and institutions of higher education opposed to contraception coverage — "don't have to contract, arrange, pay or refer for" such coverage, according to the federal government.

2. President Donald Trump has indicated he would work to reverse the birth control mandate, but it is uncertain now what approach he will take, according to the report.

3. This week, the U.S. Department of Justice asked the Fifth Circuit U.S. Court of Appeals for 60 additional days to negotiate with East Texas Baptist University in Marshall "and several other religious groups objecting to a requirement to which they are morally opposed," according to the report. However, the report notes, it remains to be seen whether the department will continue defending the mandate or wait for any pending action from the new administration.
