Cape Fear Valley Health System Appeals FirstHealth's CON

Cape Fear Valley Health System in Fayetteville, N.C., has appealed the state's decision to award 28 beds to FirstHealth of the Carolinas in Pinehurst, N.C., according to a Fayetteville Observer report.

Earlier this year, Cape Fear Valley and FirstHealth had applied for a certificate of need to add the beds to its hospitals in Fayetteville and Hoke County, respectively. However, the state awarded the CON to FirstHealth in November.

Cape Fear Valley filed a petition with the Certificate of Need Section of the North Carolina Department of Health and Human Services and with the North Carolina Office of Administrative Hearings. The appeal stated that FirstHealth was awarded the CON based on inconsistent representations about projected numbers and sources of patients.

FirstHealth officials could not be reached for comment on the appeal, according to the report.
